Ok...so last sunday...some bmw backs up into my recently purchased car... if any of you knew wylin's s14... it was that >:I
and now the other company is saying there may be a dispute...and im thinking HOW?!?? any comments or help? the story is below.
(Setting)
I was driving south, down the second aisle from the left of the North Sears entrance, when through the opening in the aisle this BMW makes a dangerous entrance into the parking aisle which forced me to brake. I was about one and a half car lengths away from her when she had entered into the aisle without stopping, slowing or even looking down the aisle; or she would have known that there was a car behind her when she later stops to reverse.
(Actual Accident)
She continued down the aisle about 25 feet and came to a stop. I came to a complete stop approximately 5-8 feet behind and protruding off to the driver’s side of Janice’s car, and was waiting for her for a full 3-5 seconds to park or continue down the aisle when her reverse lights came on with her brake lights still illuminated. I honked a couple times to let her know that I was behind her, but her brake lights turned off and she proceeded to reverse. I fully engaged my horn and was continuously making a sound to let her know that I was behind her but she continued to reverse and seemed to accelerate and the rear driver’s side of her BMW made contact with the front passenger of my car.
After putting her car into park, which I noticed as the reverse light flickered off, we both exited the vehicle and she began to apologize repeatedly and stated that she had not seen me.
HOW .... omg and i don't like mercury...they're saying they'll fix aesthetic damage up to $1000 on top of "factory" specs but not mechanical... any insurance company suggestions that'll fix intercoolers if damaged and etc.?

Had that happen to me a while back. Just keep on the insurane company, they like to try to screw you at first just to see if you'll take it. What was the total damage done?

Bumper's gone...good thing i found a replacement jdm aero... GOD i thought i was never going to find that bumper in time... headlights gone, corner gone...fender slightly bent, intercooler bracket bent... from what i could tell...
any good insurance company recommendations for modded cars??

They are haggling. Tell them you want a full repair to the condition that the car was in before the accident. Call your insurance company have them go after her too. she admitted fault, they seem willing to settle, balls in your court.
Doesn't matter who you got. She has to cover it ALL. No matter if you are modified.

oh yeah...if they admit fault they do have to cover it, but my insurance is saying because the liability isn't yet determined they're coverage is only this and that and blah blah balh >:O

why? shes not an idiot, shes a fairly good driver.
the only female that would get upset is one that is stupid, and thinks ALL females are good drivers. its quite obvious that a lot of women are NOT good drivers.
note: i didnt say that they're dangerous drivers, I said that they're not GOOD drivers. men are good drivers, but most of us... including myself LOVE playing with danger. shit, its our nature. girls tell us not to touch their breasts.. what do we do? we do that shit because its fun.
anyway......... i digress.
my solution is to get your insurance IMMEDIATELY involved... dont waste time talking to these lackeys.
ps: wow, will sold his car? even more wow, you're actually keeping those 1984 wheels of his? haha :-) change the wheels and the rest of the car is will be fine...

Anyway, same thing happened to me before in the past. I don't get how people cannot hear you after doing all that honking. Probably on the phone or something. At least you found a bumper already.

OP~SO sorry about the car! It is such a well built car! I agree with Mike....don't let them hassle you on this. My sis had some dumb bitch back into her, and they ended up paying her. Try to go back and see if there are ways to get pics. Hope that helps you some. Good luck and keep us updated.

ok here's the lowdown... when you make mods to your vehicle you must report to insurance. And unfortunately certain mods are not covered by insurance policies because they see it as a risk to "wreckless" driving. Trust me i've tried before and plus i have quite a few tuner friends who sell insurance. If its stock turbo equipment then you are fine, but those are aftermarket... you CAN sue this woman in court for that cost! It's the best way.
Here's what i'm doing... i had a collision where a guy tried to pass me while i was backing up and didn't see him... insurance says it was 60% my fault. So i'm waiting for 2 years to sue him. By law, auto accidents have a 3 year statute of limitations (which means you can sue them up to 3 years after the incident). So by then in 2 years the person will have none of the receipts or proof of what happened. The court will completely rule in my favor. Try these tricks when screwing people who screwed your car. I love the law sometimes.
ANyways, do u have witnesses? That's the key, but not always because I had 2 and the insurance still said it was my fault.
In your case, they may state that you were negligent because you had enough time to back up and check around or what not. Trust insurances always screw us... GOOD LUCK!

OP: Why didn't you reverse your car while honking instead of watching her back into your car? You should've had at least 6+ feet behind you.

you claim from her insurance, not yours; because its her fault.
you contact your insurance company and they're suppose to deal with her insurance company. if you have a good agent they will help you, by probably asking you to fill out a report documenting your side of the incident. if all pans out correctly, you'll get your money soon enough.

i did not have a witness... a lot PACKED with cars but no witnesses...
and the wheels... i actually don't like them much neither...think i can get at laest 600-700 for them?

hey man, its gonna take a while. the whole process for me took 2-3 months. but i ended up getting close to 2 grand, when i originally asked my lady to pay me 500 cash. lol.
dont stress tho, of course shes gonna say its your fault. this is where your insurance company comes into play. for my incident, my insurance company sent over a package of forms, one had a diagram box which i could explain the whole situation. i made it VERY CLEAR in every possible way of what happened (date, time. lighting, n-s-e-w, everything) make it as clear as possible so the companies know you're not bsing.
oh, and stop contacting her insurance regarding the incident. only time you talk is when they tell you where to get quotes and shit for the damage, and ask, "wheres my money, bitch?" it should all be thru your insurance (thats why you got insurance).
ill keep my fingers crossed for ya. good luck.
ps- i had a witness, but as soon as i asked him to stay, he was like no no, no no no, and ran off. oh well, still got my money!

UNLESS...they both have the same insurance company and mercury's acting like a bitch about it. Ive had an insurance company do this to me a long time ago.
Again...USAA FTMFW!!!:bigok: Had somebody back into me, all USAA told me just get a quote from one of their listed bodyshops. Went to 3 of them in my area, used the one with the highest quote, came out to about $2400 for a cracked fiberglass bumper and a dented fender. They gave me the option to take the money, so I took it and run. I fixed my bumper and bought me a GT2871R. From the day the accident happend to the time i saw the money deposited in my checking account took about 8 days.

the SAME situation happened to me in my 240, they reversed into my car. it was a woman driver. she sucked balls.
lets just say, i got my car fixed with no problems.

I'm going threw something similar since my car was backed into at a gas station (while it was parked)... For all the modifications I've done, the insurance company (Allstate) told me that they'd only reimburse me if I could find receipts for the parts... The car'll then get appraised again, and you have to fight with them over the depreciation value.
ALSO... the guy who backed into me was trying to say it was my fault (even though the damage to my car is in the MIDDLE of my car, while his is at the rear bumper... classic "backing into someone scenario," eh?). Anyway, because there were no witnesses, the insurance companies are obligated to back up their insured, and they ruled everything inconclusive. Without any evidence besides one word over another (despite the damage) the insurance will NOT give either person any money. It will not effect your insurance rates, but you are otherwise screwed to fit charges unless you have collission coverage (in which case your insurance will go up still, since they paid up). Find a witness, or take it to small claims court already.
My lesson? ALWAYS call the police if you're involved in an accident. I was a passenger recently when someone backed into us going home, and my buddy called the cops. The cop who came said it's very important (especially in SoCal) to report an accident and have statements written down at the scene so that way both parties have written stories that both agree on (to make sure no one's lying). The cop also says that when he comes he runs the drivers' licenses and there's usually a 50% chance someone involved has a criminal charge, expired or suspended license, unpaid tickets, or something like that... in which case the officer is obligated to give that driver a CITATION and the driver is obligated to report it to their insurance company. Since the driver was involved in the accident, they will also immediately be somewhat at fault (more than 1%) even if they were originally not at fault at all.
