Illegals screwed up my car, now they won't pay!

Alright so I've got a 92 s13 hatchback, and the motor blew on it. I have the shell sitting in front of my house while I'm workin on the engine. The other day I heard this crunch sound, I thought it was the garbage truck, but then my cell phone rings and my buddy up the street was like, "dude you gotta come outside quick some truck just ran into your car!" so I go out front and theres this beater white pickup w/ the tailgate down crunched up against the front of my car!it knocked over all our trash cans and sandwiched them in between the 2 cars. Whoever parked the truck left it in neutral w/o the ebrake on. These 2 mexicans come over and their all "what happened?" I was like, is that your truck? and they go "shit" and started to move it b4 I could get any good pictures. Neither one of them would tell me their name, and they didn't have a driver's license. I asked the guy who was driving for his driver's license # and he was all "uh, license? no have it here, at home maybe?" So they get me on the phone w/ their boss, they got all freaked and and called him when I said I was gonna call the police, and the guy says he doesn't wanna go through insurance, that he'd just cut us a check for w/e the damage was. Well we got an estimate it was like $1,450, and he said that was too much and said to just go through his insurance. That wouldve been fine except now the f***er is saying some kids pushed the truck, that HE was driving, and that he dropped the truck off there and was the next street over. That is such bullshit, when we talked to him on the phone he was in his office, and my buddy actually saw the truck roll into my car! This guy's not payin up, but I want my freakin car fixed! Also since I have no names for the actual drivers, it's almost like they were never there as far as the US law is concerned. I'm all for immigration, legally, but when people come into this country illegally and f*** up, theres no way to track them down it's not fair! anywho now idk what to do I think I'm gonna go file a police report, but any advice you guys have got would be appreciated.

it turns out, i may saound weird but in the state of cali. it really does not matter who is driving the car because the registered owner is the one resposiable for any damaged caused my his or her car. call your insurance company and as them. I was in a very simlar situation where the lady behind me rear ended me, after the accident she made up this bullshit about how i cut her off so she would get the heat.

I filed a police report, they didn't do shit b/c its basically my werd vs hers.

So i went to their insurance company and contacted them about the incident.

My insurance company and her worked suthing out where they would pay for half the damages. even though she didn't admit fault they still reenburst me for half.

get there full name and insurance company and bitch out to their insurance company and they will HAVE to do somthing.

except for the fact that immigration is a federal issue not a local issue. you should always file a report with the police in any accident unless both parties agree not to make claims. why would you want to deal with this on someones word? your car is totalled in most insurance companies opinions. it would cost more to fix than its worth as far as they see it.

ok, the thing is, I'm not some cutthroat guy who wants to get revenge or get someone deported because they parked wrong. I just want my car fixed. What I'm mad about is that the guy is denying the claim saying it isn't his fault, that his truck was pushed into mine. I don't know if that would hold any water since nobody can push a car if it is in gear or has the ebrake on, and it couldn't have been my car's fault since it doesn't even have an engine.
And to all of you saying I'm racist by calling these guys illegals, I'm no racist, it's not a racial slur if it's true, and people do come here illegally from other countries besides Mexico, so by equating the term illegal with Mexican, that makes you racist. If you read further up, I already said why I call them illegal- afraid of police, no names but their boss's, broken english, and no driver's license for either one of them. If I said all Mexican yard workers in California are illegal, that would be racist, but come on, they weren't exactly upstanding citizens.
Small claims court has crossed my mind, but it's a big hassle, and I'm a college student 4 days a week with a job on most of the other days, so time for that would be an issue.
Bottom line here- the people a landscaping contractor hired screwed up my car w/ his truck, and he doesn't want to take responsibility for it. He keeps changing his story and is trying to weasle out of paying up. I'm getting screwed here, and it looks like the only way I'm gonna get what I'm legally entitled to here is by playing hardball with the guy.

I hate to be the bearer of bad news but you're not gonna get anything for this incident. One of the first things that will come up if this ever goes to court will be why your car was parked in the street without an engine in the first place.

It's illegal in CA to park a non-running car in a public street, so I'd say your car without an engine fits the bill. You are just as much at fault as the other guy. If you do take this to court that will come up, and the judge will dismiss the case calling it a mutual at fault. Hey I know....I watch People's Court... :p

So your only option is to suck it up, get your car out of the street, and fix it with your own cash.

Oh and there AREN'T swarms of illegals in CA, but there ARE swarms of Mexicans(illegal or not) in SO CAL....haven't you ever been to the local swap meet? Or WAL-MART, or Casa Blanca, or Hemet, or Rubidoux? This is just a few places, I could go on.....

not calling the police is the stupidest shit you can possibly do. ive seen too many situations where the person at fault tries to turn everything around. if for watever reason you decide NOT to call police, and settle outside of insurance.. grab a sheet of paper, write down exactly what happened, adding a clause stating who was at fault, AND HAVE THE COCK SUCKERS SIGN. grab all their info.. and give them no more than one day to get what you need. you'll have a legally binding signature.. done and done.. they won't be able to fuck u as its a legally binding contract. at any rate.. call the police asap..

bud! do you know if this truck was a personal vehicle or commercial., if it was commercial there should had been a CA number on the side of the truck.. and you can call DMV motor Carrier division ask for there insurance information and put a claim. or else put a claim on your insurance and they will subrogate on the insurance company of the vehicle that ran into you. and remember you have a witness. the owner of the vehicle will get his lic suspended., it does not matter if he was driving or not driving it. he is still responsible.

ok so heres an update- I only have liability on my car right now but it was still insured- whether or not it had a motor it was insured, so I can't get slapped w/ having a non-op vehicle on a californian roadway. We're getting in touch w/ this guy's insurance company to get it taken care of. However, since he's bein such a pain about it, I am going to report him to the bbb, and let them deal with him. He can get in a lot of trouble for hiring unlicensed drivers to drive for his company. I'm gonna get as much fixed as I can, no half assed work.

Was your car plated? If not, it's also technically illegal to park a non-plated vehicle on the road.

Basically, any vehicle that is not in running condition and/or is not insured and plated cannot be parked on a public roadway or lot.
