View Full Version : CA Smog Techs Needed: Selling Car Help

I have a '91 coupe that I'm trying to relieve myself of. I know it won't pass smog since the vacuum lines are routed wrong and I'm sure that there are other things preventing from passing the test for selling. I have a PNO on it and wondering if I can legally sell the car without paperwork and do I have to take off the license plates? I'm looking to get $2000 for the car and I know having smog papers would yield me that but I'm a student and needing to buy tools for when I graduate in 5 months. The '96 I bought used my tool money but I needed a relible car so I must sell the 13. Can I sell as is legally?

Are the vacum lines obvoiusly not connected? is the check engine light on? If you said no to both the questions then maybe you can pass smog. SHOOT I DID! =)

I honestly didn't mess with any vacuum lines but I know the EGR valve isn't working and that the fuel pressure regulator and the BPT are T'd together, obviously not supposed be like that since one is ported vacuum and the other is manifold vacuum. I had it on the load dyno at school with a five gas analyzer and the NOx was off the charts; that high. I don't have time or the money for this. I guess the lines got crossed when I put in the new engine.

Exactly. My friend has purchased 2 240's out here in the bay area that were not smogged. So as long as the buy know this, you will be fine. Also we he/she takes the vehicle to the DMV, it will be their responsibility to smog the vehicle if they plan or registering it.

technically i believe the seller is supposed to smog it. However, if you make it very clear in the bill of sale and to the customer that it is being sold unsmogged, i think you'll be fine.

You can sell the car without smogging it. Once you submit the "Notice of Transfer and Release of Liability" (paperwork or online) Bill of Sale and sign off your title the vehicle is no longer yours...as long as the new owner does their part and mosey on over to the DMV to submit the paperwork. You only have a few days to submit the "Notice of Transfer and Release of Liability"...I'd do it online and immediately after you make the sale. It saves you another trip to the DMV. But, don't forget to print a copy or do a screen grab if submitted online.

It now becomes the responsibility of the new owner to smog it. If the new owner lags with the smog, he/she will not receive the new title/registration card with their name on it until the smog cert is received by the DMV. The new owner will only receive an "Incomplete Application" until proof of smog has been submitted.

The new owner will be responsible for the fees involved with registration. It can be pricey especially if the car has been non-op for a while.

Per DMV the seller is suppose to smog before a sale. This relieves the new owner from the hassle of smogging and speeds up the new owner registration process.

I have a couple things to do so it'll be up for sale this week. being that the bill of sale is a legal contract after signing I think that will be fine. Thanks for the help.

Post your car on ebay and sell it to a non CA resident. A lot of other areas don't have the strict smog requirements that you guys have.

ive bought plenty of cars without smog. I just tend to get the price of the car lower to compensate for me having to do it.
