seeing as how i posted pics when i f'd up my ankle really bad, i figured i should put some up of my head as well. it has been a about 56 hours since the incident, so it has healed significantly, but today was the first time i changed the bandages, so i couldn't take any pics earlier. maybe i'll take some more in the next couple of days when i change them again. enjoy &nbsp;<img src="http://www.zilvia.net/f/iB_html/non-cgi/emoticons/biggrin.gif" border="0" valign="absmiddle" alt=':D'>

yes, with a flashlight. if you have a mag-lite in your house, go pick one up, and you'll easily see how it could happen. can you say "assault with a deadly weapon?" not sure if legal action will be taken. i could probably put him in jail, but it'd be a big hassle, i just want $400 for my lost week of work.

i got a concussion for few seconds after it happened, cause i don't remember it, and when i came too, i was kinda staggering around blind from the blood, when i realized what happened, i started swinging at all 4 of em. yes, there was 4 of them and one of me. i was so confused i couldn't put together what actually happened, and by the time i did, the kid that did it had ran off into the woods (we were camping).

as best as i can remember this is how it happened;

me and a couple of friends were partying with this other group of guys, who were cool, except for 1 douchebag. we left, and my other friends wanted to pee on their tent, so we went back. my other friends started yelling shit at this dude, then he and his friends came out. my friends weren't really trying to start anything, we were just f'n around. but then this punk kid just started runnin his mouth and wouldn't stop, of course, with my short temper, i took exception to it. so i went back, threw him on the ground and told him to stf up. his other 3 friends separated us, and things had calmed down, which is the last thing i remember until the blood in my face. so, the way i figure it he was standing behind his other 3 friends that had separated us, then while they were holding me, he took a swing. pretty dirty. at least that is how i piece it together. he could argue self defense i guess, but was the flashlight really neccessary? i didn't have a weapon of any kind, and there were 4 of them. i mean, c'mon.

Seriously, I hope alcohol was involved. &nbsp;That just sounds like a bad idea gone stupid. - peeing on their tents, then getting into a fight w/ guys that were for the most part pretty cool.

Whos hits someone witha maglite.... that could have really fucked you up. You should feel lucky you where not injured more. It doesnt take that much to crush your skull if its hit right.
I used to skateboard w/ this kid and one day he tried to smith grind down this small 4 step rail. His back truck caught and sent him flying.. hit the side of his head on the sidewalk.. He is no completly deaf in that ear and has trouble hearing out the other...
Peeing on there tent.. come on Tnord, I figured your the type of guy that would skip all &nbsp;that and just kick his ass.

Travis, i'm thinking you could really screw this guy, and in the end it's the insurance company that dishes the loot anyways...

with a wound like that i'd go for $10,000,000 at least...

then settle for $5,000 and put it all in the 240, except for a few hundred so you can buy a helmet and wear it all the time, John Olerud style

whats more is that thats a scar thats on your face for the rest of your days, mind you most guys will think it's cool as hell, but a judge will side with you on your claim of physical disfigurement.

perhaps you could get a crazy settlement.

shit, i did alot less and got sued for a hell of a lot more, so you should ahve no problem at all especially with your pics, just delete teh one with the big ass smile...

and split the loot with me...

i doubt his insurance covers assault. it would have to come out of his/parents pocket. besides, i'm not one of those people that does that kindof stuff, although it is very tempting. i don't know if any action will be taken at all, seeing as how it's not like i was just standing there and some random dude whacked me.

my friends well, one was in the woods trying to be sneeky and come around the back to jump em, and the other guy, well, i'm not too clear on where he was, standing right behind me i think. come to think of it, where the fuck was he? i swear, my friends are the biggest bunch of pussies, that's why i'm the one that always gets it. another time two guys were after me, one gave a pretty pussy punch to the face, and my friend sat in the car and watched. i need new friends.

as far as the scar goes, the doc said it might require plastic surgery to repair......we'll see what they say on thurs when they get taken out.

As for legal action, there' this whole doctrine of "unclean hands" that says a jury or judge usually won't give you relief if you were doing bad stuff. &nbsp;I think any legal action might be met w/ "he started it" and you'd be done. &nbsp;

And yeah - those friends suck. &nbsp;Something about guys who start a ruckus, then leave the big guy to take care of it piss me off. &nbsp;W/ my friends, it's always the little ones starting fights and me and my friend Big Tom stopping them (usually w/ words since he's a 6'5" 350 lb. former PAC-10 lineman! &nbsp;)

I like the POW story - except that those 10 Canadian guards were probably killed by our "friendly fire" in Afganistan &nbsp;<img src="http://www.zilvia.net/f/iB_html/non-cgi/emoticons/confused.gif" border="0" valign="absmiddle" alt='???'>

don't worry, i know where they live, and i have a substantial amount of friends that live near by that are just waiting for me to give them the word. but how much better am i than he then? i'd much rather take him 1 on 1 then have a group of guys pound him.

actually that's a great idea, i'll give him the option of paying me money, he can go to jail for assault with a deadly weapon, or entering into a boxing ring (ala toughman) with me. then we'll see who's left bleeding.

good eyes M5. what you missed is a 355 and a 996 though. and that 993 is a Turbo S, not just a turbo. just outside the picture with the RR type R is the RR NSX, and it's signed by somebody, but i don't know who. i got it from a friends brother who didn't know who had signed it either.

and it should be covered under house insurance, like i said before, i did alot less and got sued for alot more and they settled and i dont know how much they got. you have pictures to document and all. what if you have to spring for plastic surgery...

i hit someones CAR with a paintball, fired from a $45 wal-mart paintball gun... that is it....

and they sued for $1,000,000 and settled for what i'm sure is thousands...

i didnt even hit the person, and they said they had lost their sex drive and will to live. they were apparently tramatized by the whole event which they originally reported as: "it sounded like a rock hitting the windshield"

which it didnt because i fired from the side of the vehicle...

that doesnt even compare to what happened to you, let the lawyers take care of it and take their share, it will take time, but you should have any expenses covered.

bing (and others on the sue bandwagon): [this is not legal advice and I know nothing about the local law of these specific jurisdictions] &nbsp;The way that it basically works is that you can recover if someone did something clearly against you. &nbsp;If you shoot a moving car w/o provocation, you are instigating AND breaking the law. &nbsp;The claim there would likely be assault or itentional infliction of emotional distress (as well as any codified civil statutes). &nbsp;Your facts fit. &nbsp;That someone actually sued for it (beyond any damage or just teaching you a lesson may be assinine, but wholly w/n in their rights)

Travis' case is a little different. &nbsp;It's not like he walked up, they grabbed him, and he was brained w/ a maglight. &nbsp;He instigated an argument and committed what is legally assault and battery. &nbsp;Both the victim and those around him are generally allowed a qualified right of self defense. &nbsp;In most states, the force may not be deadly (i.e., gun or knife), but about anything else goes. &nbsp;I'd doubt clubbing someone w/ a maglight would be considered deadly force. &nbsp;Therefore, his case is very different. &nbsp;That said, if a lawyer will take it on a contingency, you've got nothing to loose and maybe you could get a settlement or a windfall jury verdict - or maybe there's something special about local law.

I feel bad for Travis b/c I've had other people get my ass kicked too - but this is one of those that I think you have to chalk up to a bad idea.

Travis- Ouch. &nbsp;Here's to an easy and speedy recovery. &nbsp;That didn't do any bone damage did it? &nbsp;At that point I think you might have a case. &nbsp;Otherwise I'm with Hippo and you on this. &nbsp;It wasn't unprovoked, even if it was a bit excessive. &nbsp;Civil law is much different than criminal law. &nbsp;hell we read about a case where someone was robbing a home and fell through the skylight and successfully sued for negligent care of the skylight. &nbsp;It wouldn't be the most ridiculous case ever. &nbsp;I think that goes to the woman who had a weekly public access spot where she listed off the people she was suing and why. &nbsp;The "best" being the children in her apartment building for walking up and down the stairs in their rollerblades.

It's the sue happy responces that make insurance so expensive. &nbsp;Sure it's a big company that can afford to give him a little cash for his troubles, but don't be so nieve to believe that they don't pass all their costs back to the people buying policies. &nbsp;Nothing is ever free.

Insurance paying the claim is a whole other issue. &nbsp;Generally, no insurance covers foreseeable consequences of intentional acts. &nbsp;Insurance covers "risk" not known or non-fortuitous loss. &nbsp;

And yes, insurance cos. will raise rates based on increased risk for frivilous or inflated claims. &nbsp;The risk pool for that policy holder will rise and the premiums will be upped to take return the risk ratio to the appropriate level. &nbsp;

A personal favorite is hearing people who've been in accidents talk about their insurance rates being too high! &nbsp;I've never wrecked a car, although I've had two comprehensive claims for break-ins (totallying about $3700) - over the last 13 years! &nbsp;Over that time, I've paid out probably close to $20K in premiums. &nbsp;Meanwhile some guy who's only been driving for 3 years totals his car and hurts someone (meds). &nbsp;He's been paying a whopping $1500/yr - total of $4500 and has claimed $30K or so in damages <img src="http://www.zilvia.net/f/iB_html/non-cgi/emoticons/sneaky.gif" border="0" valign="absmiddle" alt=':pissed:'> &nbsp;Okay, ins rant over...

went to the bars with my other friend that was there at the time last night. he was standing right next to me and didn't see me get hit either. but when he realized what happened, he started attacking the other dudes as well, i just didn't notice it. so my friends aren't such pussies after all. and we also came to the conclusion that the flashlight must have been THROWN at me, which is how i ended up with it, and why i never saw it coming. it was fucking dark as hell out in the woods in the middle of nowhere. also, i get my stitches taken out in 1 hour. whoopee &nbsp;<img src="http://www.zilvia.net/f/iB_html/non-cgi/emoticons/biggrin.gif" border="0" valign="absmiddle" alt=':D'>

let's get this straight, I never pissed on his tent, my friends were gonna do it, and i didn't have anything better to do, so i just went along. anyway, i just got back from the doctor, and they were able to take all but 1 stitch out, and the rest of it is healing really well, so plastic surgery probably won't be neccessary. the bad part is i still have like 5 weeks before i can play basketball again.......this really blows.

good eyes M5. what you missed is a 355 and a 996 though. and that 993 is a Turbo S, not just a turbo. just outside the picture with the RR type R is the RR NSX, and it's signed by somebody, but i don't know who. i got it from a friends brother who didn't know who had signed it either.</td></tr></table><span id='postcolor'>
