View Full Version : Transfering titles on a car with previous ref tickets..

im tryin figure this out, I was told by a friend that *my car, with ref tickets that I have payable fines that I am paying* will probably need to be taken to a ref if I transfer titles?

Im trading cars. Being that my tickets I could pay off, I didnt think the car would need to be reffed for a title transfer, I was thinking maybe just needs to be smogged, and would be good to go.

Can anyone who has sold/transfered a car with a prior ref ticket confirm? thanks

I think you need to smog a car (if you're the seller) before you sell it. I don't think the DMV honors "trades".

the smog certificate is good for months.

The certificate is good for 90 days, IIRC.

you shouldnt have a problem transferring titles unless they changed the law from last year. my coworker sold his car a few months ago due to a ref ticket and just had to pay the fines. the ref ticket was marked mandatory (he couldnt just pay the fine) but because he was selling it, just paid the fine and that was that. miss that car too. its in the new superstreet "fade to black s14"

i had like 2 ref tickets on my crx when i sold it. they were never cleared or anything. its been like 2 1/2 years an i have'nt heard anything about its since I gave him the pink.

Sorry to bump an old thread, but this is relevant to my current situation. How much was your buddy's fine? I just got sent to the ref, and I was planning on telling the guys that I'm going to non-op it. Once I get a new car, then I'm probably selling my S13, to be done with the hassle. Is it still true that you can sell a car with a ref ticket and your responsibility is clear?

good question... I have heard however, about undercover cops catching people selling sr'd cars and going to jail for it (not sure why tho)... =/ not sure on the specifics, I heard this awhile back... you might wanna look into that.

Umm... Wtf did you hear that. You can't get thrown in jail for selling a swapped car. You sell the car as an offroad vehicle and dont drive it to the seller if you suspect anything.

The fine for a state ref ticket is about $735. Simply nonopping the car won't help being as how you were driving it when you were caught. So you'll still need to take the car to the ref. If you do choose to pay the fine then you will get a point on your license.

As for people selling SRed cars and going to jail, one could assume the undercover cop asked if the car was street legal and/or if it would pass smog, and the person selling the car, said something stupid.

As for Ref tickets, the ticket is on you, not the car (until you take it to the ref anyways).

either way you have to pay the ticket.... i had to do it even if you say you dont have the car you still have to pay for it the only way you might get out of it if you put the stock engine in it and the check light isnt on take it to state reff to get it pass... it doesnt matter if you have the car now or not... i even changed the reg. to arizona and the jugde didnt care she told me it didnt matter the car wasnt reg. to arizona the day i got the ticket.

Huh? Its the sellers responsibility, though I doubt anyone would be taken to court over it. And if the car was smogged within 90 days before the transfer its legit, so it DOES matter when it was last smogged.

Just checked up on this at the DMV...

Smog Certification
If the vehicle is over four years old, it is the seller's responsibility to provide proof of a current smog certification unless the vehicle registration was renewed with the California DMV within the past 90 days. Proof of smog certification is not required if the title to the vehicle is being transferred within a family.

So it is seller's responsibility, but every car I have bought private party, I had to go get the smog cert myself. :loco:

So, if I:

a) pay the fine
b) tell the judge I non-op'd the car
c) keep or sell the car

.. then I'm kosher in the eyes of the law?

I hope I don't sound like too much of a noob, I just want to square this away and move on with my life. (I know, it sounds cliche`, but i got so much shit going on, the last thing I needed was law & car problems).

I guess my car is going up for sale soon. Anyone interested in a 91 coupe with a recently swapped SR20, with lots of suspension mods? :mepoke:

Ive always wondered if you buy a car that got ref'd, do you still need to ref it or do you just get it smoged like is required with a normal transfer.

This is pretty much raising the dead here, I know but, is it still possible to sell off a car with a ref ticket and take the fine and point on license? I've got a few possible trades or sales for my car, but would just like to make sure first.
