car deal gone terribly wrong... advice?

maaaaaan... where to start.

this guy is selling a car on traction optional. he says that everything is fine... and that the car runs reliably and will have no problem running reliably for another month.

I have the car delivered... the motor is blown.

I gave him 200 as an initial "down payment" the day of the pickup (my friend picked it up) because he said that he needed the title for insurance or whatever. I was being nice. 200 now, 250 when I got the title.

so I offer to take the car back to him (with an oil and oil filter change in the same condition as I bought it) and he says that he wont take it back and give me my money back.

he then threatens to a)beat my ass b) come to my house and kick my ass c) call the cops and report it stolen. and says that I am not getting my money back and that he is demanding the other 250. then he calls my 200 a donation.

he is being quite childish in the matter... and I'm basically stuck. what are my options?

Did your friend get a bill of sale from him? If he did then you can take him to small claims court and he can not report it stolen.

Always use a bill of sale from the DMV website regardless. You should contact local authorities and possibly go to small claims court for this. It's a hassle, but better then getting screwed over.

Get a consultation for a friend of a family who is either a lawyer or heavily involved in law. See if they can give you a word of advice.

But in all honesty, you may be screwed. Always ALWAYS get a receipt. Chalk this up as a leason learned and dont do it again. Part the car and move on.

how about giving him some realistic advice instead of telling him to do shit that will potentially get him arrested. go and talk to a cop, ask him what you can do about the harrasment issues. then go to the dmv, people always post shit assuming that ppl on the forums are lawyers or know something that the dmv doesn't. its like going to mcdonalds to ask were you can buy a home surround system.

edit, you can sell exterior (fenders/ hatch or trunk and shit like that then have the shell picked up and im sure someone can use the spare engine for a ka-t rebuild. i watched an episode of judge judy and this kid had the same problem but with a motorcycle. There were threats too just like yours too. At the end the guy had to pay for the remainding balance or return the item. you have to take a loss on this one sorry, i would just part the car out.

The point of whatever you do is to teach this fucker a lesson. So the best way to do this would be for you too come out on top. You need to part the car out. Take as much of as fast as you can. Anything that is good enought shape to sell. You need to then move this to one of your buddies houses. After this is done, call the cops and explain to them about the threats. Tell them about the harrasment, and then say one day you woke up and this car was in your yard just like it is. If it still has any vin numbers, they can trace it back to you dude. Then he would have to pay to move the car, you would have parts to sell to get your money back, and i'm sure you could get a restaining order all in one process. No bill of sale, no proof that you know the car exists. Therefore you make money, you get him in with the law a bit, you come out on top, and maybe this guy learns his lesson. Just my two cents.

How did u communicate with this guy from the beginning? If your contact with him was through email, do you have the email of him stating that the car is in reliable condition? If you have this, you can use this in the small claims court. This proves that he said the car IS in reliable condition, but when you got it it had a blown motor, which indicates false advertisement/claim.

I don't know about your local laws, but there is no "cooling off period" in CA. In other words, you can take a used car back at any time if it isn't in the condition as described. I would speak to a dealer about your local laws and what you can do. In the event that he still refuses, notify the police of the threats. Maybe he's on probo or parole and he will get sent back to his boyfriends.

What kind of car is this first? I assume s13 since it only $450. Sell fender, hood, bumper, doors, full black interior (if black), hatch or trunk, cluster (dohc is more popular), head, any mods, rear subframe and anything and everything you can. I am pretty sure you cant make $250 easily on these if they are in pretty good condition. Then you have to cut up the car or just ditch it somewhere. The car is not your so it wont come back to you. Leave the block in there otherwise you have sold a stolen motor, the rest have no vin.

IF this is a s14, you can make $250 off the seats alone.

Otherwise I'm with mrlonelys13. Just get as much illegal stuff as possible and put it in his car. Hit and run something and leave. Even better yet hit something that you own but dont care about and then sue him. Leave no trace that you know this guy and pretend like he is a complete stranger.

okay well first off if this is something you want to finish up on principal then #1 you have to establish that a sales transaction is being made. Right now if you take him to court he can just deny that you ever even gave him money in the first place. So how about sending him an email being specific about what has happend. Hopefully he'll reply w/ some form of guilt being admitted to which he'll end w/ demanding $ for a POS car.

Once you have that in writing, technically you can take him to civil court. Have a lawyer write up a nice intimidating letter that demands action to be met. Upon readin he will go find a lawyer on his own which a) get freaked out b/c of lawyer fee's and end up swallowing the costs b) hire a bangin' lawyer who shall proceed to kick you in the nutts lawfully.

chances are A is the common route. Now do I suggest getting a lawyer... hell no, its not worth it.... you couldn't get a lawyer to write you a letter for 250 let alone fight a case for that amount. but b/c you go to civil court you are then able to sue him for more then the amount of the car. Please talk to your lawyer regarding various charges you are entitled too. Then the car goes probate while the situation is being litigated and in the end it all will not be worth it. If the guy is smart he'll just drag it out over a long period of time b/c small claims court is 80% of the time not worth it.

I suggest just getting him to admit guilt on paper / email and then pressuring him that he's already admitted guilt and that he'll lose in court. The guy doesn't sound too bright so he'll probably fold and get you the $ back once you give him the car. Chances are he already spent the $ and is living paycheck to paycheck. W/ that being said... once he refunds you and you return the vehicle..... he will probably proceed to kick your silly ass.

500 for a fucking shell? maybe i just live in a dream world or something b/c my first 89 se i bought for 300 from the original owner and had to put a fuel pump in it. the second one i bought was a 90 non-se with a busted tranny and i gave 750 for it with stock replacement brembo rotors aftermarket springs and some other stuff. my 3rd shell that i got was a 89 se with full interior which i got 2 motors 2 trannies extra diff 2 extra sets of doors and more stuff for 375. my 92 coupe i just got i gave 850 for which was to much but i had to fix another tranny and it works great with a very very stright body which needs paint. dream world???

Why not get a lien on the car, its the legal way of him losing his car. If you have a friend at a auto shop or whatever and do some bullshit repairs like timing chain yada yada and you state that this guy asked you to take the car for repairs. When the bill arrives to over $1000 and refuses to pay than the shop puts a lien and they own the vehicle, then they can transfer it to you for whatever lien costs are which is like $130. And you get a fresh title.


Sucks you dont live in Florida, if you had the car in possesion for more than 30 days with dated documents than for $130 you can file a personal lien and the car becomes yours.
