View Full Version : need help with DUI procedures

ok here's the deal...

about a month ago June 17, 2006 i was pulled over and received DUI (had 2 beers). at the time i was 20 yrs old (2 weeks away from my 21st b-day). so my license is suspended for 1 year.

here's some things i'm kind of confused about:

am i suppose to file the sr-22 under dmv or my insurance company. i've been researching on-line and different sites say different things. unfortunately my current insurance just cancelled my policy a few days ago so i've been driving without insurance. or am i suppose to have insurance to file for sr-22

also i haven't received anything from the state regarding my DUI offense, it's been about a month now and i'm not sure if i'm suppose to go to court or not. i know i'm suppopse to pay a fine of $100 because i was under the age of 21.

i've been reading my ticket of suspension over and over and says nothing about court. i'm just nervous i'm suppose to do something and have missed it or something.

i know there's a few more stuff on my mind but i'm too stressed out right now to think of it...

any help will be greatly appreciated.

I've had my license suspended for a yr before for not having insurance and getting into a little car wreck, unfortunately, I learned the hardway when I was 17. Anyway, yes you'll need to go through an insurance company and tell them you need to file an SR-22 and insurance for the vehicle. I think it's like an extra $30-50 to file an SR-22.

I never had a court date when my license was suspended, the dmv takes care of it all. But about DUI though, you may want to check at your local PD office and see what the hell is going on before they get a warrant out for your arrest.

Have you been convicted of the dui yet?

IF NOT, go get an attorney.... SERIOUSLY. Get a loan, pay with a cc, i think you should do whatever it takes to get a lawyer..

and yes...if you are being charged with a dui, you will have a court date...didn't they give you any paperwork? Did you admit to having 2 beers?

If you know for sure you blew atleast a .08BAC dont even waste your money on a lawyer your guilty and there is nothing to fight except maybe proceedure flaws be preparied to spend alot of $$$$$$, so many people think they can fight a DUI but 99% there still found guilty, you can go get a copy of your BAC from the county which you got the ticket from and see for yourself what you blew, best bet if you blew a .08BAC on the dot you might be able to get it reduced to a lessor charge called wet wreckless which still sucks.......if your in California a DUI stay on your record for 10 years now, good luck getting a job that requires you to be insured for any type of driving what so ever....its like a jail sentence you serve on the outside

Most states, or at lest mine has a 0 tolerance policy on any bac if your under 21.

thats what i'm thinking.

To blow a .08 i think he would have had to CHUG the two beers and go drive right away..... right? Depending on how fast he drank them and how soon he drove, there is a good chance that he got the dui with a LESSER BAC just cause he was underage..

technically a 20 year old(in cali as far as i know) can get a dui with a BAC of like .01 or .02 just cause he is underage... I think if he blew like a .06 or something a lawer could help him a lot.....

btw- can you tell us the whole story? I think we are all interested.

at the time, he wasn't, so thats two things there...drinking and driving and drinking under the age

call the court and see if you're in the system

yea i got an order of suspension of license. but thats it, it doesn't say court date or what not. right away i admitted to having the 2 beers ( which i had a 11:00 PM and i was pulled over around 3:30AM) and at that time already i was pretty much sober but it was still in my system otherwise i wouldn't have drove. officer said that there wasn't enough in my system to be arrested or my car towed for it but since i was under 21 at the time its a zero tolerance so i know there is no point of me fighting it.

as for my story nothing really interesting...

went to a friends birthday party in Long Beach, ghetto side of it, started drinking at 11:00PM. had more than 2 beers. left the party around 2:00AM, i live about 30 miles from long beach and i wasn't feeling buzzed or anything so i knew i was ok to drive but still knew there was the risk. so i was about 5 minutes away from home, right about to exit to go home when the CHP who just got onto the freeway a few exits before mine decides to pull me over. said i was driving close to the center divider, which at the time the freeway was under major construction so there was those concrete borders put up. i recently sold my '90 s13 hatch and so i was driving a temporary car, '97 honda accord for the time being. i was still getting used to driving a monster of a car...so much body roll on that car so i kind of swerve naturally due to me being new to the car. so after i admitted to drinking officer asks me to get out of car, and i was pretty tired and sleepy at the time so i kind of stumbled out of the car. walked the line, followed the pen, stood on one foot...stumbled a little more because i was tired. took the breathilizer (sp?) and told me i didn't have enough alcohol in my system to be arrested but since i was under 21 i wasn't suppose to drink at all. had my friend drive my car home the rest of the way.

this DUI really sucks because i was planning on finishing up some college courses to work at a lexus dealership as a technician but must not have a DUI. so i'm kind of screwed. lesson well learned...

Fuck that... Go get an attorney...If its THAT important for you NOT to have a dui.....


If it didn't even show up on the breathalizer, you should still have your licence in my opinion....

you pwn3d yourself when you told him you drank earlier... did he even ask you? or did you use that as your excuse for driving close to the center.

it sounds like the entire alcohol topic could have been avoided. Get a lawyer

some of my friends got out of it but i dont know how since i do hang out with them anymore. i just know they got some chinese lawyers from san gabriels could take this matter.

i hope this would be a lesson for everyone here.

yea i realized it hours after everything happened. it was really my first time getting pulled over so i was nervous. guess i should have just said i was tired but oh well everythings happened already...fuck

Honestly sometimes it's easier if you were honest in the first place. Makes it a whole lot easier on yourself and the cop. Next time I would eat a bunch before leaving home and bring chewing gum and some nasty ass cologne with you. Never know when you just might need the gum and cologne.

My thinking is, if I knew I drank beer and haven't ate anything before leaving/driving and a cop pulls me over...most likely he's going to smell it. It'd be much easier if you didn't try to lie yourself out of it when you're pretty much in the spotlight already and you're just getting yourself into more trouble.

yeah but you dont need to draw unnecesary attention to the illegal things. If you get pulled over for a busted tail light, you dont mention your SR20 etc.
