will a 5 speed swap from a s13 fit into a s14

yes it will physically fit (and work).
howerver, there is no place for the S14 speed sensor on the S13 tranny.
you'll have to drill the S13 for one or swap bellhousings with an S14.
This has been covered many times. try the search and you'll find what you need to know.

I think you mean the Flywheel/crank position sensor at the top of the bell housing. Its just an OBD thing, so if you don't need to pass smog for what ever reason it won't be an issue.

If we were in court, the lawyer for the defense would stand up and say, "Objection; asked and answered." Judge replies "Sustained." (I think I saw it on Matlock or something.)
And then some overzealous Zilvian would tell you that you need an S14 Manual VSS or else your speedo (not the one you're wearing, the other one) will read 120 when you are doing 60. Not all bad though. You can take a pic to impress your friends...
Then another Zilvian will come along and yell, SEARCH NOOB and scold the other Zilvian for spoon feeding said noob. He will then remind the first Zilvian that it is his turn to wash the silverware. The first Zilvian then becomes infuriorated that he dirtied said spoon while spoon feeding said noob, and stabs said noob to death with said spoon. Moral of the story. Said noob would still be alive had he used said SEARCH button...

i have an s13 tranny in my 98 s14 i wont pass smog cuz of the crankpos sensor but everything is the same except the clutch pedal/master.

Yah, if Kentucky is anything like Commi-fornia, then you'd be better off just getting the later tranny. Easier than finding a VSS by itself maybe. I also swapped to an S13 tranny which I got from the seller of my car. Other than the CPS and VSS, it's all good.
Of course if emissions is an issue, you'll still get a DTC #84 for the AT diagnostic comm line, regardless of what tranny you use. I think the only fix to that is swapping to a manual ECU.

Think about it.
Tranny = engine specific.
Clutch and related = chassis specific.
BTW the driveshaft won't fit.
